Abstract

An editorial on the double censorship, governmental and typographers’: the first legal but abusive, the second illegal and unaccountable. Ortega draws the thesis that one can no longer govern by force, since the state does not stand above society but is immersed in it, and unjust authority breeds social illegality.

Después del colapso de un día vuelven hoy los periódicos madrileños a pulsar en las calles. Por nuestra parte, no decimos que en este retorno al trabajo nos hallemos con el ánimo satisfecho. Desde el momento que la censura roja se puso a combatir con la censura negra al través de nuestros cuerpos cuotidianos, todos los periódicos debieron darse transitoriamente por muertos. Ésta fue nuestra opinión: ni un día, ni una hora debimos prolongar una apariencia de vida que sólo servía para sustentar el vejamen y el deshonor. No triunfó nuestra opinión: como suele, para desdicha nacional, suceder siempre, venció esta vez también lo ineficaz y lo confuso. Y henos de nuevo con la pluma en la mano, pluma que las circunstancias convierten en un pequeño remo de galera.

Usemos de él, ante todo, para marcar con alguna precisión nuestro juicio sobre el conflicto de la doble censura. No serán tal vez líneas perdidas las que escribamos, porque encierra el caso un ejemplo clarísimo de cuál debiera, a nuestro juicio, ser en todos los problemas actuales la verdadera política.

El Poder público se ha reservado, en previsión de situaciones extremadamente graves, el establecimiento de la censura. La Constitución y la ley de Imprenta no ponen trabas suficientes al uso de este abuso, y he aquí uno de los muchos motivos que hacen urgente la reforma constitucional por nosotros demandada. Pero, en fin, el ejercicio de la previa censura por el Gobierno es un acto legal, cuando menos, en el sentido en que es legal un acto abusivo de la autoridad. Un poco de tacto y otro poco de respeto a la nación, de respeto a sí mismos, hubieran impedido a los gobernantes desprestigiar con la frecuencia de su empleo esta delicadísima ley, que hoy, frívolamente convertida en un miserable artefacto de tortura intelectual y política, contribuye no poco a incitar todos los instintos subversivos de las clases más descontentas.

Tiene el Poder público órganos constructivos y órganos agresivos: la porción menos inteligente de nuestra sociedad cree que la autoridad se fortalece ejercitando a menudo éstos, y no parece nunca apresurarse en exigir que funcionen aquéllos. Conocemos muchos ciudadanos que no se ocupan de política más que para pedir a los Gobiernos la administración de la violencia. Pero acaece que, aparte la ruindad de este temperamento, las alturas de la historia por que ahora bogamos lo hacen contraproducente. Hoy no sólo no se debe, sino que no se puede gobernar con la fuerza. El Estado no se halla, como en otros tiempos, sobre la sociedad, sino que vive inmerso en ella, flotando en medio de la opinión pública. Y ésta, más fuerte que él, es quien lo nutre de autoridad moral, única duradera y eficiente.

Contra una violencia del Poder público, siempre hallará la sociedad o parte de ella algún arma de análogo poder ofensivo. Así ha ocurrido con la censura gubernamental al querer prohibir la publicación de noticias ciertas sobre las huelgas. Los tipógrafos han respondido a la ley violenta con una violencia ilegal. Lleva, sin duda, el Gobierno la irónica ventaja de que todo lo que él hace es legal. La sociedad, o parte de la sociedad, cuando se siente herida, responde a su manera. Y su manera suele ser francamente ilegal.

La injusticia de la autoridad engendra inevitablemente la ilegalidad social.

Nosotros hemos combatido con toda la energía que permite el vocabulario, nuestra única arma, los abusos de censor cometidos por los Gobiernos. Recuérdese nuestra campaña del estío contra el uso que de la mordaza hacía el entonces gobernador señor López Ballesteros. Pero claro es que la censura roja tiene caracteres más tiránicos aún que la del Poder público. Sobre ser ilegal, es irresponsable. El ministro censurador puede ser nominativamente atacado en el Parlamento, y, aunque no es ello muy fácil, puede ser llevado a la barra. Además, la censura del Gobierno es ejercida por empleados también responsables y centralizada en una oficina que aplica a todos los periódicos un mismo rasero.

Nos parece un poco ridículo adoptar en cuestiones como ésta una actitud de matamoros. Las cosas deben ser dichas clara, honesta, reflexivamente y sin patética… Un periódico no puede pretender arrollar la Asociación del Arte de Imprimir. Cada uno de nosotros, los periodistas, es un pedazo del organismo unitario que forman desde el linotipista hasta el director. Ni nosotros sin los tipógrafos, ni ellos sin nosotros, podemos vivir. Queramos o no, estamos inexorablemente fundidos los unos con los otros. Parece, pues, obligado que extremen los obreros del taller el respeto civil que deben a los demás que colaboran en la obra común, y que cuiden en sus disensiones con el Gobierno de no herir al que está más cerca de ellos, precisamente por ejercer el oficio más fraterno. Nosotros no somos ni el Gobierno ni la Empresa: somos el periódico mismo. Lo que dañen a éste, dañarán a sí.

Juzgaríamos de mal gusto recordar hoy a los obreros cuáles son las doctrinas políticas que defiende este periódico. Aunque no fueran las que son, nos creeríamos con todos los derechos para ser atendidos y respetados. Porque, en fin de cuentas, lo que exigimos frente a la censura roja ilegal, como ante la legal censura negra, es libertad. Y el coartar ésta nos parece mucho más inaceptable en el obrero que en el Gobierno. Si esta libertad nos falta, El Sol tendrá, sin más frases, que suspender su publicación.

After the collapse of a day, today the Madrid newspapers return to pulse in the streets. For our part, we do not say that in this return to work we find ourselves with a satisfied spirit. From the moment the red censorship set itself to fight with the black censorship through our daily bodies, all the newspapers should have given themselves transitorily for dead. This was our opinion: not one day, not one hour should we prolong an appearance of life that served only to sustain the vexation and the dishonor. Our opinion did not triumph: as usually, to national misfortune, always happens, this time too the inefficacious and the confused won. And here we are again with the pen in hand, a pen that circumstances turn into a little galley oar.

Let us use it, above all, to mark with some precision our judgment on the conflict of the double censorship. Perhaps the lines we write will not be lost, for the case encloses a very clear example of what, in our judgment, the true policy should be in all present problems.

The public Power has reserved for itself, in anticipation of extremely grave situations, the establishment of censorship. The Constitution and the press law put no sufficient obstacles to the use of this abuse, and here is one of the many motives that make urgent the constitutional reform demanded by us. But, in the end, the exercise of prior censorship by the Government is a legal act, at least, in the sense in which an abusive act of authority is legal. A little tact and a little more respect for the nation, respect for themselves, would have prevented the governors from discrediting with the frequency of its employment this most delicate law, which today, frivolously converted into a miserable artifact of intellectual and political torture, contributes not a little to inciting all the subversive instincts of the most discontented classes.

The public Power has constructive organs and aggressive organs: the least intelligent portion of our society believes that authority is strengthened by exercising often the latter, and never seems to hasten to demand that the former function. We know many citizens who do not occupy themselves with politics except to ask Governments for the administration of violence. But it happens that, apart from the meanness of this temper, the heights of history through which we now navigate make it counterproductive. Today not only must one not govern with force, but one cannot. The State does not find itself, as in other times, above society, but lives immersed in it, floating in the midst of public opinion. And this, stronger than it, is what nourishes it with moral authority, the only durable and efficient one.

Against a violence of the public Power, society, or part of it, will always find some weapon of analogous offensive power. So it has happened with governmental censorship in wanting to prohibit the publication of certain news about the strikes. The typographers have answered the violent law with an illegal violence. The Government carries, no doubt, the ironic advantage that everything it does is legal. Society, or part of society, when it feels wounded, answers in its own way. And its way usually is frankly illegal.

The injustice of authority inevitably engenders social illegality.

We have combated with all the energy that the vocabulary, our only weapon, allows the abuses of censor committed by the Governments. Let our summer campaign be recalled against the use that the then governor, señor López Ballesteros, made of the gag. But clearly the red censorship has characters even more tyrannical than that of the public Power. Besides being illegal, it is irresponsible. The censoring minister can be attacked nominatively in Parliament, and, although it is not very easy, he can be brought to the bar. Moreover, the censorship of the Government is exercised by equally responsible employees and centralized in an office that applies to all the newspapers one same standard.

It seems to us a little ridiculous to adopt in questions like this an attitude of braggart. Things must be said clearly, honestly, reflectively and without pathos… A newspaper cannot pretend to run over the Association of the Art of Printing. Each of us, the journalists, is a piece of the unitary organism formed from the linotypist to the director. Neither we without the typographers, nor they without us, can live. Whether we want or not, we are inexorably fused one with the other. It seems, then, obligatory that the workers of the shop carry to the extreme the civil respect they owe to the others who collaborate in the common work, and that in their dissensions with the Government they take care not to wound the one closest to them, precisely for exercising the most fraternal office. We are neither the Government nor the Company: we are the newspaper itself. What they damage to it, they will damage to themselves.

We would judge it bad taste to recall today to the workers what are the political doctrines this newspaper defends. Even were they not what they are, we would believe ourselves with every right to be attended and respected. Because, when all is said, what we demand before the illegal red censorship, as before the legal black censorship, is liberty. And the constraining of this seems to us much more unacceptable in the worker than in the Government. If this liberty fails us, El Sol will have, without more words, to suspend its publication.

Dopo il collasso di un giorno tornano oggi i giornali madrileni a battere le strade. Da parte nostra, non diciamo che in questo ritorno al lavoro ci troviamo con l’animo soddisfatto. Dal momento che la censura rossa si mise a combattere con la censura nera attraverso i nostri corpi quotidiani, tutti i giornali avrebbero dovuto darsi transitoriamente per morti. Questa fu la nostra opinione: né un giorno, né un’ora dovevamo prolungare un’apparenza di vita che serviva soltanto a sostenere il vilipendio e il disonore. Non trionfò la nostra opinione: come suole, per disditta nazionale, accadere sempre, vinse anche questa volta l’inefficace e il confuso. Ed eccoci di nuovo con la penna in mano, penna che le circostanze convertono in un piccolo remo di galera.

Serviamocene, innanzi tutto, per segnare con qualche precisione il nostro giudizio sul conflitto della doppia censura. Non saranno forse linee perdute quelle che scriviamo, perché racchiude il caso un esempio chiarissimo di quale dovrebbe essere, a nostro giudizio, in tutti i problemi attuali la vera politica.

Il Potere pubblico si è riservato, in previsione di situazioni estremamente gravi, lo stabilimento della censura. La Costituzione e la legge sulla stampa non pongono ostacoli sufficienti all’uso di questo abuso, ed ecco uno dei molti motivi che rendono urgente la riforma costituzionale da noi richiesta. Ma, in fin dei conti, l’esercizio della previa censura da parte del Governo è un atto legale, almeno, nel senso in cui è legale un atto abusivo dell’autorità. Un po’ di tatto e un altro po’ di rispetto alla nazione, di rispetto a se stessi, avrebbero impedito ai governanti di screditare con la frequenza del suo impiego questa delicatissima legge, che oggi, frivolmente convertita in un miserabile artefice di tortura intellettuale e politica, contribuisce non poco a incitare tutti gli istinti sovversivi delle classi più scontente.

Ha il Potere pubblico organi costruttivi e organi aggressivi: la porzione meno intelligente della nostra società crede che l’autorità si rafforzi esercitando spesso questi ultimi, e non sembra mai affrettarsi a esigere che funzionino i primi. Conosciamo molti cittadini che non si occupano di politica se non per chiedere ai Governi l’amministrazione della violenza. Ma accade che, a parte la bassezza di questo temperamento, le altezze della storia per cui ora navighiamo lo rendono controproducente. Oggi non solo non si deve, ma non si può governare con la forza. Lo Stato non si trova, come in altri tempi, sopra la società, ma vive immerso in essa, fluttuando in mezzo all’opinione pubblica. E questa, più forte di lui, è chi lo nutre di autorità morale, unica durevole ed efficiente.

Contro una violenza del Potere pubblico troverà sempre la società, o parte di essa, qualche arma di analogo potere offensivo. Così è accaduto con la censura governativa volendo proibire la pubblicazione di notizie certe sugli scioperi. I tipografi hanno risposto alla legge violenta con una violenza illegale. Porta, senza dubbio, il Governo l’ironico vantaggio che tutto ciò che lui fa è legale. La società, o parte della società, quando si sente ferita, risponde a modo suo. E il suo modo suole essere francamente illegale.

L’ingiustizia dell’autorità genera inevitabilmente l’illegalità sociale.

Noi abbiamo combattuto con tutta l’energia che consente il vocabolario, la nostra unica arma, gli abusi del censore commessi dai Governi. Si ricordi la nostra campagna d’estate contro l’uso che della mordacchia faceva il allora governatore signor López Ballesteros. Ma chiaro è che la censura rossa ha caratteri più tirannici ancora di quella del Potere pubblico. Oltre a essere illegale, è irresponsabile. Il ministro censore può essere attaccato nominativamente in Parlamento, e, sebbene non sia cosa molto facile, può essere portato alla sbarra. Inoltre, la censura del Governo è esercitata da impiegati anch’essi responsabili e centralizzata in un ufficio che applica a tutti i giornali un medesimo criterio.

Ci sembra un po’ ridicolo adottare in questioni come questa un atteggiamento da spaccone. Le cose devono essere dette chiare, oneste, riflessivamente e senza patetica… Un giornale non può pretendere di travolgere l’Associazione dell’Arte di Stampare. Ciascuno di noi, i giornalisti, è un pezzo dell’organismo unitario che formano dal linotipista al direttore. Né noi senza i tipografi, né essi senza di noi, possiamo vivere. Vogliamo o no, siamo inesorabilmente fusi gli uni con gli altri. Sembra, dunque, obbligato che gli operai del laboratorio estremizzino il rispetto civile che devono agli altri che collaborano nell’opera comune, e che curino nelle loro dissensioni col Governo di non ferire chi sta più vicino a loro, proprio per esercitare l’ufficio più fraterno. Noi non siamo né il Governo né l’Impresa: siamo il giornale stesso. Quel che danneggino a questo, danneggeranno a sé.

Giudicheremmo di cattivo gusto ricordare oggi agli operai quali sono le dottrine politiche che difende questo giornale. Sebbene non fossero quelle che sono, ci crederemmo con tutti i diritti di essere ascoltati e rispettati. Perché, in fin dei conti, ciò che esigiamo davanti alla censura rossa illegale, come davanti alla legale censura nera, è libertà. E il coartare questa ci sembra molto più inaccettabile nell’operaio che nel Governo. Se questa libertà ci manca, El Sol dovrà, senza altre frasi, sospendere la sua pubblicazione.
