Abstract
Against the constitutional breach of arbitrarily extending the budget, and against La Cierva’s “thesis” that taxes may be collected without a vote of the Cortes. Ortega claims a thousand-year-old Spanish liberty, learned not from Robespierre but from the old Chronicles and the Cortes of Madrid of 1329.

Los que somos liberales por devoción y no de oficio necesitamos manifestar nuestro desacuerdo con algunos liberales de oficio y no por devoción que se sientan en el Congreso. La actitud de éstos frente al hecho de la infracción constitucional cometida al prorrogar arbitrariamente el presupuesto es de todo punto insatisfactoria. De las dos batallas dadas la última semana en el Parlamento, han reservado la menor para la causa mayor. Yo no trato de quitar importancia a las truculencias electorales ejecutadas por este Ministerio de mosquitas muertas. Precisamente he podido asistir en primera fila al espectáculo de su deshonestidad gubernativa. El Gobierno, favorable a mis aficiones de observador social, ha elegido una persona que me es muy próxima para ensayar en ella su máxima capacidad de atropello. He visto, pues, cómo el señor La Cierva enviaba a las provincias gobernadores con psicología de leopardos, y he presenciado bien de cerca la selvática escena de los alanos gobernantes dando caza a un candidato en la espesura de un distrito serrano. ¡Cuál no habrá sido el desmán, que el Gobierno mismo ha tenido que mudar de provincia al leopardo y el Tribunal Supremo anular la cacería!
A pesar de ello, me parece inconmensurable la gravísima infracción constitucional con cuanto haya podido cometer el basto joven bullanguero que ha estado clueco en Gobernación, o con la espontánea ayuda prestada por el mirífico ministro de Gracia y Justicia a las decisiones del Tribunal de Actas.
¿Cómo es posible que a estas fechas no hayan tocado a rebato todas las espadañas de libertad, haciendo leva general de los hombres libres? Se trata de un caso en que todos, del tradicionalista al socialista, han debido sentir igualmente vulnerada su sensibilidad civil. Yo no he aprendido a conmoverme por esta libertad en los discursos de Robespierre, sino en las Crónicas más viejas de nuestra tierra, donde la he oído bramar entre los vagidos natales del habla castellana. Ni es posible, para quien no tenga muerta la memoria, caminando por la gleba nativa, divisar a lo lejos las torres doradas de una ciudad o de una villa sin recordar que acaso en ella se celebraron Cortes, las cuales usaron de esta franquía. ¡Libertad de mil años, que era ya inveterada cuando iniciaban su germinación las más viejas encinas de nuestros paisajes actuales!
Bueno fuera que los votos de una mayoría ocasional, en una simple junta de diputados, bastasen para extirpar a España su más añejo y excelente honor de civilidad.
Es de advertir que no se contentó el Gobierno con arrancar de soslayo una aprobación de sus actos, sino que nuestro almojarife don Juan de la Cierva sostuvo lo que él llamó su tesis. Y esta tesis, «esto que he querido demostrar…» —dice el Diario de Sesiones—, consiste sencillamente en «que habiendo sido votados los tributos por leyes especiales, que aprobó el Parlamento y sancionó la Corona, los tributos se pueden y se deben cobrar, aunque el plan de gastos y el plan de contribuciones y medios para atender a ellos, como dice el artículo 85, no se haya votado por las Cortes».
De modo que, según el almojarife, no sólo el segundo año, sino hasta el fin de los tiempos, puede regir un presupuesto. Y claro es que si pudieran cobrarse los tributos indefinidamente, no se entiende para qué exige la Constitución la discusión y votación de un presupuesto, a lo menos, bienal.
Las citadas palabras del señor La Cierva no provocaron el furioso encrespamiento de los instintos liberales que luego han producido cualesquiera solecismos parlamentarios del señor Goicoechea. Contra pareja falta de congruencia en las reacciones de los diputados liberales es contra lo que reclamamos. Y es preciso que cien veces y en cien formas distintas, si fuese menester, se haga volver al Congreso sobre esa «tesis» del señor La Cierva, que nos retrotrae a los tiempos… ¿A qué tiempos? Yo no lo sé exactamente, porque me encuentro con una ley hecha en las Cortes de Madrid en 1329, donde Alfonso el Onceno dice: «Otrosí, a lo que me pidieron por merced de les non echar ni mandar pagar pecho desaforado ninguno especial ni general en toda la mi tierra sin ser llamados primeramente a Cortes, e otorgado por todos los procuradores que y viniesen: a esto respondo que lo tengo por bien e lo otorgo».
Esos «pechos desaforados» o ajenos a fuero corresponden a nuestros presupuestos anuales. Alfonso XI no hizo en esta ocasión otra cosa que refrendar la explícita norma formulada por su padre, Fernando IV, en las Cortes de Valladolid, de 1307. «Esta concesión de pechos y servicios —escribe Colmeiro— fue la prerrogativa esencial de los procuradores de las ciudades y villas, autorizada por la costumbre y reconocida por Alfonso X en las Cortes de Burgos, de 1269, y después respetada por sus sucesores».
Un día, en 1419, don Juan el Segundo apremiado por la urgencia de una guerra contra el rey de Inglaterra, hace recoger «ocho monedas» sin previa autorización de las Cortes. Reunidas a 1420 en Valladolid, los procuradores le dicen estas sencillas y patéticas palabras: «Que sentían muy gran agravio al presente e muy grant escándalo e temor en sus corazones de lo que adelante se podría seguir por les ser quebrantada la costumbre e franqueza, tan amenguada e tan común por todos los señores del mundo, así católicos como de otra condición, la cual toda su autoridad e estado sería amenguado e abajado, non quedando otro previllejo nin libertad de que los súbditos pueden gozar levantando el sobredicho».
Conste, pues, que en 1329 y en Madrid, Alfonso XI reconocía a los castellanos un derecho que en 1919 y en Madrid, un ministro de Alfonso XIII nos recoge. Evidentemente, retrogradamos. Los señores Maura y La Cierva andan nostálgicos de nebulosa primitiva y han hallado ya en el ministro de Gracia y Justicia un representante de lo paradisiaco.
Mas no creo que esta involución convenga a la Monarquía. Hoy vivimos sin ley en España: los tributos pueden no ser pagados en buen derecho, porque el decreto del Gobierno es de aquéllos que, según los Códigos castizos, «han de ser obedescidos, pero non cumplidos».
Si el Rey pudiera equivocarse —the King cannot wrong—, nos parecería incontestable que se había equivocado ahora trayendo a redropelo un Gobierno extemporáneo. Porque no es posible que los liberales, cualquiera que sea su matiz, consientan en que se les arrebate este postrer «previllejo e libertad» que gozábamos. No creo que la nación española viva tan envilecida que soporte el entuerto. Aún tengo esperanza de que suenen tañidos en las espadañas y a la voz de «¡Libertad!, ¡Libertad!», se junten algunos corazones capaces de sentir el «gran agravio del presente e el grant escándalo e temor por lo que adelante se podría seguir».

We who are liberals by devotion and not by profession need to manifest our disagreement with some liberals of profession and not by devotion who sit in the Congress. Their attitude before the fact of the constitutional infraction committed in arbitrarily proroguing the budget is unsatisfactory in every respect. Of the two battles given in the last week in Parliament, they have reserved the lesser for the greater cause. I do not try to take importance away from the electoral atrocities executed by this Ministry of harmless-seeming flies. Precisely I have been able to attend in the front row the spectacle of its governmental dishonesty. The Government, favorable to my tastes as a social observer, has chosen a person very close to me to try out on her its maximum capacity for abuse. I have seen, then, how señor La Cierva sent to the provinces governors with the psychology of leopards, and I have witnessed close at hand the wild scene of the Mastiff governors hunting down a candidate in the thicket of a mountain district. What an outrage it must have been, that the Government itself has had to move the leopard to another province and the Supreme Court annul the hunt!
Despite it, the gravest constitutional infraction seems to me incommensurable with whatever the coarse rowdy young man who has been brooding in the Interior Ministry may have been able to commit, or with the spontaneous aid lent by the wonder-working minister of Grace and Justice to the decisions of the Electoral Returns Court.
How is it possible that at this date all the bell-gables of liberty have not rung the alarm, making a general levy of free men? It is a case in which all, from the traditionalist to the socialist, should have felt their civil sensibility equally wounded. I have not learned to be moved by this liberty in the speeches of Robespierre, but in the oldest Chronicles of our land, where I have heard it bellow amid the natal cries of Castilian speech. Nor is it possible, for one whose memory is not dead, walking over the native glebe, to descry in the distance the golden towers of a city or a town without recalling that perhaps in it Cortes were held, which made use of this franchise. Liberty of a thousand years, which was already inveterate when the oldest holm oaks of our present landscapes were beginning to germinate!
It would be a fine thing indeed if the votes of an occasional majority, in a simple assembly of deputies, sufficed to extirpate from Spain its most ancient and excellent honor of civility.
It is to be noted that the Government was not content with wresting sideways an approval of its acts, but our treasurer don Juan de la Cierva sustained what he called his thesis. And this thesis, «this that I have wanted to demonstrate…» —says the Diario de Sesiones—, consists simply in «that having been voted the tributes by special laws, which the Parliament approved and the Crown sanctioned, the tributes can and must be collected, although the plan of expenditures and the plan of contributions and means to meet them, as article 85 says, has not been voted by the Cortes».
So that, according to the treasurer, not only the second year, but until the end of time, can a budget govern. And clear it is that if the tributes could be collected indefinitely, one does not understand why the Constitution requires the discussion and voting of a budget, at least, biennial.
The aforementioned words of señor La Cierva did not provoke the furious ruffling of the liberal instincts that any parliamentary solecisms of señor Goicoechea have since produced. Against an equal lack of congruence in the reactions of the liberal deputies is that against which we protest. And it is necessary that a hundred times and in a hundred different forms, if need be, the Congress be made to return upon that «thesis» of señor La Cierva, which carries us back to the times… To what times? I do not know exactly, because I find myself with a law made in the Cortes of Madrid in 1329, where Alfonso the Eleventh says: «Moreover, to what they asked me by grace that I neither levy nor order to pay any tribute contrary to fuero, special or general, in all my land without being first called to Cortes, and granted by all the procurators who came there: to this I answer that I hold it for good and I grant it».
Those «pechos desaforados», or foreign to fuero, correspond to our annual budgets. Alfonso XI did nothing on this occasion but ratify the explicit norm formulated by his father, Ferdinand IV, in the Cortes of Valladolid, of 1307. «This concession of tributes and services —writes Colmeiro— was the essential prerogative of the procurators of the cities and towns, authorized by custom and recognized by Alfonso X in the Cortes of Burgos, of 1269, and afterward respected by his successors».
One day, in 1419, don John the Second, pressed by the urgency of a war against the king of England, has «eight coins» collected without prior authorization of the Cortes. Assembled in 1420 in Valladolid, the procurators say to him these simple and pathetic words: «That they felt very great grievance at present and very great scandal and fear in their hearts of what hereafter might follow from their being broken the custom and franchise, so diminished and so common among all the lords of the world, as well Catholics as of other condition, the which all their authority and estate would be diminished and lowered, no other privilege nor liberty remaining that the subjects may enjoy, removing the aforesaid».
Let it stand, then, that in 1329 and in Madrid, Alfonso XI recognized to the Castilians a right that in 1919 and in Madrid, a minister of Alfonso XIII takes away from us. Evidently, we retrogress. Señores Maura and La Cierva go about nostalgic for a primitive nebula and have already found in the minister of Grace and Justice a representative of the paradisiacal.
But I do not believe that this involution suits the Monarchy. Today we live without law in Spain: the tributes can be not paid in good right, because the Government’s decree is of that kind which, according to the purest Codes, «must be obeyed, but not fulfilled».
If the King could err —the King cannot wrong—, it would seem to us incontestable that he had erred now in bringing, against the grain, an untimely Government. Because it is not possible that the liberals, whatever their shade, consent to being snatched away this last «privilege and liberty» that we enjoyed. I do not believe that the Spanish nation lives so debased as to endure the wrong. I still have hope that peals will sound in the bell-gables and that at the voice of «Liberty!, Liberty!», some hearts will gather capable of feeling the «great grievance of the present and the very great scandal and fear for what hereafter might follow».

Noi che siamo liberali per devozione e non per mestiere dobbiamo manifestare il nostro dissenso con alcuni liberali di mestiere e non per devozione che siedono nel Congresso. L’atteggiamento di costoro dinanzi al fatto dell’infrazione costituzionale commessa prorogando arbitrariamente il bilancio è da ogni punto di vista insoddisfacente. Delle due battaglie date nell’ultima settimana in Parlamento, hanno riservato la minore per la causa maggiore. Io non tento di togliere importanza alle truculenze elettorali eseguite da questo Ministero di mosche morte. Precisamente ho potuto assistere in prima fila allo spettacolo della sua disonestà governativa. Il Governo, favorevole alle mie inclinazioni di osservatore sociale, ha scelto una persona che mi è molto vicina per sperimentare su di essa la sua massima capacità di sopraffazione. Ho visto, dunque, come il signor La Cierva inviasse alle province governatori con psicologia di leopardi, e ho presenziato ben da vicino la selvatica scena degli alani governanti che danno la caccia a un candidato nella folta boscaglia di un distretto montano. Quale non sarà stato l’abuso, che il Governo stesso ha dovuto trasferire di provincia il leopardo e il Tribunale Supremo annullare la caccia!
Nonostante ciò, mi pare incommensurabile la gravissima infrazione costituzionale rispetto a quanto possa aver commesso il rozzo giovane chiassoso che è stato a covare al Ministero dell’Interno, o rispetto all’aiuto spontaneo prestato dal mirabile ministro di Grazia e Giustizia alle decisioni del Tribunale delle Elezioni.
Come è possibile che a questa data non abbiano suonato a stormo tutti i campanili della libertà, facendo levata generale degli uomini liberi? Si tratta di un caso in cui tutti, dal tradizionalista al socialista, hanno dovuto sentire ugualmente vulnerata la loro sensibilità civile. Io non ho imparato a commuovermi per questa libertà nei discorsi di Robespierre, ma nelle più antiche Cronache della nostra terra, dove l’ho sentita muggire tra i vagiti natii della parlata castigliana. Né è possibile, per chi non abbia morta la memoria, camminando per la gleba nativa, scorgere in lontananza le torri dorate di una città o di una villa senza ricordare che forse in essa si celebrarono Cortes, le quali fecero uso di questa franchigia. Libertà di mille anni, che era già inveterata quando iniziavano la loro germinazione le più vecchie querce dei nostri paesaggi attuali!
Bello sarebbe che i voti di una maggioranza occasionale, in una semplice giunta di deputati, bastassero a estirpare alla Spagna il suo più antico ed eccellente onore di civiltà.
È da notare che il Governo non si contentò di carpire di traverso un’approvazione dei suoi atti, ma il nostro esattore don Juan de la Cierva sostenne quella che chiamò la sua tesi. E questa tesi, «questo che ho voluto dimostrare…» —dice il Diario delle Sedute—, consiste semplicemente in «che essendo stati votati i tributi con leggi speciali, che approvò il Parlamento e sanzionò la Corona, i tributi si possono e si devono riscuotere, sebbene il piano delle spese e il piano dei contributi e dei mezzi per farvi fronte, come dice l’articolo 85, non sia stato votato dalle Cortes».
Di modo che, secondo l’esattore, non soltanto il secondo anno, ma fino alla fine dei tempi, può reggere un bilancio. E chiaro è che se i tributi si potessero riscuotere indefinitamente, non si capisce a che cosa la Costituzione esiga la discussione e la votazione di un bilancio, almeno, biennale.
Le citate parole del signor La Cierva non provocarono il furioso arricciamento degli istinti liberali che poi hanno prodotto qualsivoglia solecismi parlamentari del signor Goicoechea. Contro pari mancanza di congruenza nelle reazioni dei deputati liberali è contro ciò che reclamiamo. Ed è necessario che cento volte e in cento forme diverse, se fosse necessario, si faccia tornare il Congresso su quella «tesi» del signor La Cierva, che ci riporta ai tempi… A quali tempi? Io non lo so esattamente, perché mi trovo con una legge fatta nelle Cortes di Madrid nel 1329, dove Alfonso l’Undecimo dice: «Inoltre, a ciò che mi chiesero per grazia di non gettare né ordinare di pagare tributo senza foro alcuno, speciale né generale, in tutta la mia terra senza essere chiamati prima a Cortes, e concesso da tutti i procuratori che vi venissero: a questo rispondo che lo tengo per bene e lo concedo».
Quei «pechos desaforados», ossia estranei al foro, corrispondono ai nostri bilanci annuali. Alfonso XI non fece in questa occasione altro che avallare l’esplicita norma formulata da suo padre, Ferdinando IV, nelle Cortes di Valladolid, del 1307. «Questa concessione di tributi e servizi —scrive Colmeiro— fu la prerogativa essenziale dei procuratori delle città e ville, autorizzata dalla consuetudine e riconosciuta da Alfonso X nelle Cortes di Burgos, del 1269, e poi rispettata dai suoi successori».
Un giorno, nel 1419, don Giovanni il Secondo, stretto dall’urgenza di una guerra contro il re d’Inghilterra, fa raccogliere «otto monete» senza previa autorizzazione delle Cortes. Riunite nel 1420 a Valladolid, i procuratori gli dicono queste semplici e patetiche parole: «Che sentivano grandissimo aggravio al presente e grandissimo scandalo e timore nei loro cuori di ciò che innanzi si potrebbe seguire per esser loro infranta la consuetudine e franchigia, tanto ammencata e tanto comune per tutti i signori del mondo, così cattolici come d’altra condizione, la quale tutta la loro autorità e stato sarebbe ammencato e abbassato, non rimanendo altro privilegio né libertà di cui i sudditi possano godere levando il sopraddetto».
Consti, dunque, che nel 1329 e a Madrid, Alfonso XI riconosceva ai castigliani un diritto che nel 1919 e a Madrid, un ministro di Alfonso XIII ci toglie. Evidentemente, retrocediamo. I signori Maura e La Cierva sono nostalgici di nebulosa primitiva e hanno già trovato nel ministro di Grazia e Giustizia un rappresentante del paradisiaco.
Ma non credo che questa involuzione convenga alla Monarchia. Oggi viviamo senza legge in Spagna: i tributi possono non essere pagati in buon diritto, perché il decreto del Governo è di quelli che, secondo i Codici castizi, «debbono essere ubbiditi, ma non adempiuti».
Se il Re potesse sbagliarsi —the King cannot wrong—, ci parrebbe incontestabile che si fosse sbagliato ora portando a rimorchio un Governo intempestivo. Perché non è possibile che i liberali, qualunque sia la loro tinta, consentano che si strappi loro questo ultimo «privilegio e libertà» di cui godevamo. Non credo che la nazione spagnola viva tanto avvilita da sopportare il torto. Ho ancora speranza che risuonino tocchi nei campanili e che alla voce di «Libertà!, Libertà!», si uniscano alcuni cuori capaci di sentire il «grande aggravio del presente e il grandissimo scandalo e timore per ciò che innanzi si potrebbe seguire».
