Abstract
The close of a series (España, 1915) on liberty: Spanish law must be reformed to guarantee the exercise of liberties and give legal standing to resistance against abuses of authority, as with the plea of unconstitutionality in Switzerland and the United States. It ends bitterly: liberty—‘the right to distance between man and man’—is now either felt or not, and Spaniards do not feel it.

Ni que decir tiene que todas estas palabras reducen a no ser sino palabras todas sus pretensiones. Pues el escritor ha cumplido su misión cuando ha escrito palabras sinceras. Que de la palabra nazca el acto como bajo la flor el fruto, no es su menester.
Aún hubiera querido dedicar algún espacio a mostrar cómo es urgente que la acción liberal española —¡si es que la hay!— se preocupe de reformar la legalidad en el sentido de asegurar el ejercicio de las libertades y dar estado jurídico a la resistencia contra los abusos de autoridad. Ya en 1789 promulgaban los convencionales que toute societé dans laquelle la garantie des droits n’est pas assurée, n’a point de constitution. Siquiera esto, los españoles no tenemos constitución. Siquiera en Suiza existe el derecho de recurso por anticonstitucionalidad de una ley, ante el Tribunal federal, y en los Estados Unidos todo juez puede aceptar la excepción de inconstitutionality, alegada por el acusado. Un decenio, cuando menos, lleva ya de vida el grande movimiento de todas las minorías liberales de Europa para construir instituciones de defensa jurídica contra el poder público, Gobierno o Parlamento. Seguramente don Fernando de los Ríos, profesor de Derecho político, podría y debería hablar al detalle de este asunto que tan bien conoce.
Mas todo será vano. Cuando se combate sin esperanza, cada bote de lanza sólo deja dolor en quien lo da. Y este asunto de la libertad, del «derecho a la distancia entre hombre y hombre», no es de aquéllos que puedan ya ser discutidos. La discusión y aun la discusión armada, tuvo su hora: hoy la libertad —como la armonía musical, como el amor y el honor—, se siente o no se siente.
Y los españoles, por lo visto, no conservan sensibilidad para esta pura, santa norma. La libertad, es cierto, no se ve, ni se toca, ni se huele. La libertad no es más que una idea.
«¡Por la idea!» —gritaban en las barricadas los progresistas del año 35, blandiendo en lo alto su trabuco, mientras una bala del Estado les partía el corazón.
¡Libertad, divino tesoro!…

It goes without saying that all these words reduce to being nothing but words all their pretensions. For the writer has fulfilled his mission when he has written sincere words. That from the word should be born the act as under the flower the fruit, is not his concern.
I would have wished still to dedicate some space to showing how urgent it is that the Spanish liberal action —if it exists at all!— concern itself with reforming legality in the sense of assuring the exercise of the liberties and of giving juridical status to the resistance against the abuses of authority. Already in 1789 the Conventionnels promulgated that toute societé dans laquelle la garantie des droits n’est pas assurée, n’a point de constitution. At least this, we Spaniards have no constitution. At least in Switzerland there exists the right of appeal for the unconstitutionality of a law, before the Federal Tribunal, and in the United States every judge can accept the exception of unconstitutionality, alleged by the accused. A decade, at the least, has already lived the great movement of all the liberal minorities of Europe to construct institutions of juridical defence against the public power, Government or Parliament. Surely don Fernando de los Ríos, professor of political law, could and should speak in detail of this matter which he knows so well.
But all will be vain. When one fights without hope, every thrust of the lance leaves only pain in him who gives it. And this matter of liberty, of the «right to the distance between man and man», is not of those that can any longer be discussed. The discussion, and even the armed discussion, had its hour: today liberty —like musical harmony, like love and honour—, is felt or is not felt.
And the Spaniards, as it seems, do not preserve sensibility for this pure, holy norm. Liberty, it is certain, is not seen, nor touched, nor smelled. Liberty is nothing more than an idea.
«For the idea!» —shouted on the barricades the progressives of the year 35, brandishing aloft their blunderbuss, while a bullet of the State split their heart.

Inutile dire che tutte queste parole riducono a non essere se non parole tutte le loro pretese. Poiché lo scrittore ha compiuto la sua missione quando ha scritto parole sincere. Che dalla parola nasca l’atto come sotto il fiore il frutto, non è suo compito.
Avrei voluto ancora dedicare qualche spazio a mostrare come sia urgente che l’azione liberale spagnola —se pure esiste!— si preoccupi di riformare la legalità nel senso di assicurare l’esercizio delle libertà e di dare stato giuridico alla resistenza contro gli abusi di autorità. Già nel 1789 i convenzionali promulgavano che toute societé dans laquelle la garantie des droits n’est pas assurée, n’a point de constitution. Almeno questo, noi spagnoli non abbiamo costituzione. Almeno in Svizzera esiste il diritto di ricorso per anticostituzionalità di una legge, davanti al Tribunale federale, e negli Stati Uniti ogni giudice può accettare l’eccezione di inconstitutionality, allegata dall’accusato. Un decennio, per lo meno, porta già di vita il grande movimento di tutte le minoranze liberali d’Europa per costruire istituzioni di difesa giuridica contro il potere pubblico, Governo o Parlamento. Sicuramente don Fernando de los Ríos, professore di Diritto politico, potrebbe e dovrebbe parlare al dettaglio di questo assunto che così bene conosce.
Ma tutto sarà vano. Quando si combatte senza speranza, ogni colpo di lancia lascia solo dolore in chi lo dà. E questa faccenda della libertà, del «diritto alla distanza tra uomo e uomo», non è di quelle che possano ormai essere discusse. La discussione, e anche la discussione armata, ebbe la sua ora: oggi la libertà —come l’armonia musicale, come l’amore e l’onore—, si sente o non si sente.
E gli spagnoli, a quanto pare, non conservano sensibilità per questa pura, santa norma. La libertà, è certo, non si vede, né si tocca, né si odora. La libertà non è più che un’idea.
