Abstract
On the Centro judge disciplined under the Law for the Defence of the Republic: when constitutive laws are badly made, a government cannot govern by them and reaches for exceptional laws; but if the case is not truly exceptional, the legal disguise corrupts the whole state. Topical political criticism.

El caso del juez del Centro y su corrección gubernativa ofrecen, por la misma sencillez del tema, el mejor ejemplo para innumerables otras cuestiones que se han presentado y se presentarán. Siempre se tratará de los mismos perros con otros collares.
El esquema general de todas esas deplorables situaciones es éste: el Gobierno está ahí para gobernar, es decir, para procurar la buena marcha de la vida pública mediante la ejecución de las leyes. Pero cuando estas leyes son torpes, el Gobierno no puede, aunque quiera, gobernar con ellas. Y como su misión ineludible y específica es gobernar, no tiene más remedio que salirse de las leyes. Esto desprestigia al Gobierno, al Poder ejecutivo, presentándolo como un poder arbitrario.
Para evitar esto el Gobierno busca el amparo del Poder legislativo, solicitando de él a matacaballo una ley excepcional cuyo sentido es contradictorio de las leyes constitutivas. Éstas son las reglas, la ley excepcional es lo irregular anidando en la regularidad misma. Y no haya duda: cuando las leyes constitutivas han sido bien hechas, atendiendo a todo lo que hay que atender, previendo todo lo que es obligatorio prever, las situaciones excepcionales se presentan sólo… excepcionalmente. Entonces, cuando las emergencias son de verdad excepcionales, se puede impunemente, sin desdoro para el Estado, promulgar una ley excepcional. Pero si el Gobierno reclama del Poder legislativo una intervención excepcional cuando el conflicto o dificultad no son en verdad excepcionales, sino perfectamente previsibles y aun, con toda verosimilitud, permanentes dada la época y el modo de la sociedad, entonces el disfraz legal no ampara al Poder ejecutivo, no le evita desprestigio, sino que, al revés, lo extiende sobre el otro poder y se corrompe íntegro el Estado.
El ministro de la Gobernación fundamentó el correctivo que había impuesto a un juez demostrando que éste no había tenido bien en cuenta todas las leyes referentes al caso. A mí me convenció plenamente de que este juez, cuando menos, no había atendido con fervor la totalidad de preceptos que en esta ocasión debía manejar. Y tal fervor en el juez no es un requilorio, sino que es obligatorio. Pero con esta fundamentación el señor Casares no aventajaba gran cosa su conducta. Porque ese insuficiente comportamiento de un juez es materia ordinaria que tiene su normal trámite de corrección, y el señor Casares no acudió a éste, sino a una instancia por completo heterogénea —al rayo de Júpiter que es la ley de Defensa.
Pero ¿tiene sentido que el Estado promulgue una ley de Defensa contra sus jueces o contra sus delegados de Hacienda o contra sus ingenieros? Esto es demasiado absurdo para que el error de donde emana no sea también demasiado profundo. So pretexto de sinceridad —es curioso que la sinceridad se use a menudo como una máscara— los ministros hacen en el Parlamento con delectatio morosa la exhibición de las lacras de la judicatura. Yo esto no lo entiendo en absoluto y menos hallándonos en una etapa de reorganización estatal. Porque ésta da por supuesto que en el Estado hay infinitas lacras, tantas que es preciso recrear íntegro el artefacto. El que las haya efectivamente en este o el otro servicio no justifica, pues, aquella especial y reiterada exhibición. Sólo se comprende que un ministro censure un servicio público en el minuto precedente a aquél en que presenta el proyecto para reformarlo. Lo contrario no es sino frívolo resabio de la oposición, de una oposición también frívola que se escuda en la maledicencia de las tertulias irresponsables.
Este temple de trasañejo casinillo «radical» dominó el ambiente español poco después del 14 de abril y nos ha estropeado la República, situándola casi íntegramente a un nivel que no permite hacer nada bien. Como esto lo dije entonces tengo algún derecho a repetirlo ahora y cuanto menos caso se me haya hecho mayor es mi derecho. Así, mes y medio justos después de advenir el nuevo régimen, en 2 de junio, escribía yo en Crisol:
«Unos cuantos grupos, que moscardean en el contorno inmediato del Gobierno, están interceptando la comunicación directa de éste con la Nación; le inquietan, le estorban, le desorientan y desazonan. Hay en el Ministerio algunos hombres de primer orden, cuyo único error grave ha sido tomar en serio a toda esa botaratería que pretende hacer de la República su propiedad privada y se atribuye tan arbitraria como audazmente, y tan audaz como ridículamente, la representación auténtica del pueblo, de la voluntad nacional, etcétera, etcétera. Mentes arcaicas, incapaces de descifrar las líneas monumentales del porvenir, sólo saben recaer en los tópicos del pasado, y se empeñan en que nuestra naciente democracia sea como las de hace cien años, y cometa, sin renunciar a ninguna, todas las insensateces y todas las torpezas en que aquéllas se desnucaron».
La ventaja de la institución republicana —decía yo en tiempo de la Monarquía— es que es hija de sus obras, que necesita ganarse la vida cada día y cada hora, que para existir no tiene más remedio que hacer las cosas bien. La Monarquía, en cambio, vive de los antepasados, de la tradición y aunque lo haga muy mal sigue largo tiempo en pie, gravitando sobre el país, como los elefantes, después de muertos, continúan sobre sus cuatro patas.
La única preocupación del Parlamento republicano y de toda su gobernación debiera ser ésta: hacer las cosas bien. ¿No va siendo ya urgente la hora de que comience a sentirla? ¿Por qué tocar las cuestiones a la ligera y de paso cuando aún no se tiene un plan para resolverlas? ¿Por qué hurgar en los servicios cuando el mismo ministro que hurga no sabe aún cómo va a reformarlos? Lo más delicado que encontró la República era su relación con el Ejército. ¿Por qué en este resorte —y salvo posibles errores de detalle que ni discuto ni juzgo— tiene el país la impresión de que se han hecho bien las cosas?
Pero hay republicanos que coinciden con Primo de Rivera en el lema general de su política, que era éste: gobernar es molestar.

The case of the judge of the Centro and its governmental correction offer, by the very simplicity of the theme, the best example for innumerable other questions that have presented themselves and will present themselves. It will always be a question of the same dogs with other collars.
The general scheme of all those deplorable situations is this: the Government is there to govern, that is, to procure the good running of public life through the execution of the laws. But when these laws are clumsy, the Government cannot, although it wants to, govern with them. And since its ineludible and specific mission is to govern, it has no remedy but to step out of the laws. This discredits the Government, the executive Power, presenting it as an arbitrary power.
To avoid this the Government seeks the protection of the legislative Power, soliciting from it post-haste an exceptional law whose sense is contradictory of the constitutive laws. These are the rules; the exceptional law is the irregular nesting in regularity itself. And let there be no doubt: when the constitutive laws have been well made, attending to everything that must be attended to, foreseeing everything that it is obligatory to foresee, the exceptional situations present themselves only… exceptionally. Then, when the emergencies are truly exceptional, one can impunely, without discredit for the State, promulgate an exceptional law. But if the Government demands of the legislative Power an exceptional intervention when the conflict or difficulty is not truly exceptional, but perfectly foreseeable and even, with all verisimilitude, permanent given the epoch and the manner of society, then the legal disguise does not protect the executive Power, does not avoid discredit for it, but, on the contrary, extends it over the other power and the whole State is corrupted.
The minister of the Interior grounded the corrective he had imposed upon a judge by demonstrating that the latter had not well taken into account all the laws referring to the case. He fully convinced me that this judge, at the least, had not attended with fervour the totality of precepts that on this occasion he had to handle. And such fervour in the judge is not a frill, but is obligatory. But with this grounding Mr. Casares did not much better his conduct. Because that insufficient behaviour of a judge is ordinary matter that has its normal course of correction, and Mr. Casares did not resort to this, but to a completely heterogeneous instance —to the thunderbolt of Jupiter which is the Defence law.
But does it make sense that the State promulgate a Defence law against its judges or against its treasury delegates or against its engineers? This is too absurd for the error from which it emanates not to be also too profound. Under the pretext of sincerity —it is curious that sincerity is often used as a mask— the ministers make in Parliament with delectatio morosa the exhibition of the blemishes of the judiciary. I do not understand this at all, and less being we in a stage of state reorganization. Because this takes for granted that in the State there are infinite blemishes, so many that it is necessary to recreate whole the artefact. That there should be some in fact in this or that service does not justify, then, that special and reiterated exhibition. It is only understood that a minister censure a public service in the minute preceding that in which he presents the project to reform it. The contrary is nothing but a frivolous leftover of the opposition, of an opposition also frivolous which shields itself in the slander of irresponsible social gatherings.
This temper of an old-club «radical» dominated the Spanish atmosphere shortly after the 14th of April and has spoiled the Republic for us, placing it almost wholly at a level that does not permit anything to be done well. Since I said this then I have some right to repeat it now and the less case has been made of me the greater is my right. Thus, a bare month and a half after the advent of the new regime, on the 2nd of June, I wrote in Crisol:
«A few groups, which buzz around the immediate environs of the Government, are intercepting its direct communication with the Nation; they disquiet it, they hinder it, they disorient and unsettle it. There are in the Ministry some men of the first order, whose only grave error has been to take seriously all that bluster which pretends to make of the Republic its private property and attributes to itself as arbitrarily as audaciously, and as audaciously as ridiculously, the authentic representation of the people, of the national will, etcetera, etcetera. Archaic minds, incapable of deciphering the monumental lines of the future, only know how to fall back upon the commonplaces of the past, and are bent on our nascent democracy being like those of a hundred years ago, and committing, without renouncing any of them, all the insanities and all the clumsinesses in which those broke their necks».
The advantage of the republican institution —I used to say in the time of the Monarchy— is that it is the daughter of its works, that it needs to earn its living every day and every hour, that to exist it has no remedy but to do things well. The Monarchy, on the other hand, lives off its ancestors, off tradition, and although it does very badly, it continues a long time standing, gravitating over the country, like the elephants which, after dying, continue upon their four legs.
The only preoccupation of the republican Parliament and of all its governance ought to be this: to do things well. Is the hour not already becoming urgent for it to begin to feel it? Why touch the questions lightly and in passing when one does not yet have a plan to resolve them? Why rummage in the services when the very minister who rummages does not yet know how he is going to reform them? The most delicate thing the Republic found was its relation with the Army. Why in this spring —and saving possible errors of detail which I neither discuss nor judge— does the country have the impression that things have been done well?
But there are republicans who coincide with Primo de Rivera in the general motto of his policy, which was this: to govern is to bother.

Il caso del giudice del Centro e la sua correzione governativa offrono, per la stessa semplicità del tema, il miglior esempio per innumerevoli altre questioni che si sono presentate e si presenteranno. Si tratterà sempre degli stessi cani con altri collari.
Lo schema generale di tutte quelle deplorevoli situazioni è questo: il Governo è lì per governare, cioè, per procurare il buon andamento della vita pubblica mediante l’esecuzione delle leggi. Ma quando queste leggi sono maldestre, il Governo non può, sebbene voglia, governare con esse. E poiché la sua missione ineludibile e specifica è governare, non ha altro rimedio che uscire dalle leggi. Questo scredita il Governo, il Potere esecutivo, presentandolo come un potere arbitrario.
Per evitare questo il Governo cerca l’appoggio del Potere legislativo, chiedendo ad esso in fretta e furia una legge eccezionale il cui senso è contraddittorio delle leggi costitutive. Queste sono le regole, la legge eccezionale è l’irregolare che nidifica nella regolarità stessa. E non vi sia dubbio: quando le leggi costitutive sono state ben fatte, badando a tutto ciò a cui bisogna badare, prevedendo tutto ciò che è obbligatorio prevedere, le situazioni eccezionali si presentano solo… eccezionalmente. Allora, quando le emergenze sono davvero eccezionali, si può impunemente, senza disdoro per lo Stato, promulgare una legge eccezionale. Ma se il Governo reclama dal Potere legislativo un intervento eccezionale quando il conflitto o la difficoltà non sono in verità eccezionali, ma perfettamente prevedibili e, anzi, con tutta verosimiglianza, permanenti data l’epoca e il modo della società, allora il travestimento legale non appoggia il Potere esecutivo, non gli evita lo scredito, ma, al contrario, lo estende sull’altro potere e si corrompe integro lo Stato.
Il ministro della Gobernación fondò il correttivo che aveva imposto a un giudice dimostrando che questi non aveva tenuto bene in conto tutte le leggi riferentisi al caso. A me convinse pienamente del fatto che questo giudice, per lo meno, non aveva atteso con fervore la totalità dei precetti che in questa occasione doveva maneggiare. E tale fervore nel giudice non è un fronzolo, ma è obbligatorio. Ma con questa fondazione il signor Casares non avvantaggiava gran che la sua condotta. Perché quell’insufficiente comportamento di un giudice è materia ordinaria che ha il suo normale tràmite di correzione, e il signor Casares non ricorse a questo, ma a un’istanza del tutto eterogenea —al fulmine di Giove che è la legge di Difesa.
Ma ha senso che lo Stato promulghi una legge di Difesa contro i suoi giudici o contro i suoi delegati di Finanza o contro i suoi ingegneri? Questo è troppo assurdo perché l’errore da cui emana non sia anche troppo profondo. Sotto pretesto di sincerità —è curioso che la sincerità si usi spesso come una maschera— i ministri fanno in Parlamento con delectatio morosa l’esibizione delle piaghe della giudicatura. Io questo non lo capisco affatto e meno trovandoci in una tappa di riorganizzazione statale. Perché questa dà per supposto che nello Stato ci siano infinite piaghe, tante che è necessario ricreare integro l’artefatto. Che ce ne siano effettivamente in questo o quell’altro servizio non giustifica, dunque, quella speciale e reiterata esibizione. Si comprende solo che un ministro censuri un servizio pubblico nel minuto precedente a quello in cui presenta il progetto per riformarlo. Il contrario non è se non frivolo residuo dell’opposizione, di un’opposizione anch’essa frivola che si scherma nella maldicenza delle irresponsabili veglie.
Questo temperamento da vecchissimo «radicale» da casinello dominò l’ambiente spagnolo poco dopo il 14 aprile e ci ha guastato la Repubblica, situandola quasi integramente a un livello che non permette di fare niente bene. Poiché questo lo dissi allora ho qualche diritto a ripeterlo ora e quanto meno caso mi sia stato fatto maggiore è il mio diritto. Così, un mese e mezzo giusto dopo l’avvento del nuovo regime, il 2 giugno, scrivevo io in Crisol:
«Parecchi gruppi, che ronzano intorno al contorno immediato del Governo, stanno intercettando la comunicazione diretta di questo con la Nazione; lo inquietano, lo ostacolano, lo disorientano e lo sconcertano. Nel Ministero ci sono alcuni uomini di primo ordine, il cui unico errore grave è stato prendere sul serio tutta quella sbruffoneria che pretende fare della Repubblica la sua proprietà privata e si attribuisce tanto arbitrariamente quanto audacemente, e tanto audacemente quanto ridicolmente, la rappresentanza autentica del popolo, della volontà nazionale, eccetera, eccetera. Menti arcaiche, incapaci di decifrare le linee monumentali dell’avvenire, sanno solo ricadere nei luoghi comuni del passato, e s’incaponiscono che la nostra nascente democrazia sia come quelle di cent’anni fa, e commetta, senza rinunciarne ad alcuna, tutte le insensatezze e tutte le goffaggini in cui quelle si ruppero l’osso del collo».
Il vantaggio dell’istituzione repubblicana —dicevo io al tempo della Monarchia— è che è figlia delle sue opere, che ha bisogno di guadagnarsi la vita ogni giorno e ogni ora, che per esistere non ha altro rimedio che fare le cose bene. La Monarchia, invece, vive degli antenati, della tradizione e sebbene lo faccia molto male continua a lungo in piedi, gravitando sul paese, come gli elefanti, dopo morti, continuano sulle loro quattro zampe.
L’unica preoccupazione del Parlamento repubblicano e di tutta la sua governanza dovrebbe essere questa: fare le cose bene. Non va diventando già urgente l’ora che cominci a sentirla? Perché toccare le questioni alla leggera e di passaggio quando ancora non si ha un piano per risolverle? Perché frugare nei servizi quando lo stesso ministro che fruga non sa ancora come li riformerà? La cosa più delicata che la Repubblica trovò era la sua relazione con l’Esercito. Perché in questa molla —e salvo possibili errori di dettaglio che non discuto né giudico— il paese ha l’impressione che si siano fatte bene le cose?
Ma ci sono repubblicani che coincidono con Primo de Rivera nel lema generale della sua politica, che era questo: governare è disturbare.
