Abstract
A polemic against minister La Cierva’s project of ‘reforming customs’: custom is the product of two factors, individual character and the vital medium, and to change the product one must change a factor. Custom is therefore unlegislatable — banning it is like banning earthquakes; only when custom and ideal coincide is law born.

One begins to speak in Spain, in these last years, of good customs. The theme is quite new, but it has caught on with such success that few will be the unwilling Spaniards who do not consider Spanish customs as the worst imaginable, and when half of Spain asks: «What are the good customs?», the other half answers: «The customs of Germany, the customs of England». And if, by chance, a Minister of the Interior comes along sufficiently ingenuous or sufficiently ironic to solicitously pick up these rumours, he says that he counts on public opinion —which is what almost all Spaniards count on—, and he resolves to reform the customs. The people applaud. How could they not applaud, if this is the old and eternal «Stage of Wonders»? Whoever does not applaud is not virtuous. And one applauds and one brings up for comment and redundantly all the commonplaces of a certain thing they call Sociology and of another that they ought to call moral statistics. And all Spain, like that braggart of spatula and breeches, falls in the end into the ecstasy of good customs. And I cannot but recall the exclamation of Bonaparte, when he read the transports of rhetorical rapture in which Madame de Genlis praised virtue: «This madam speaks of virtue as of a discovery».
I understand perfectly that Señor La Cierva, devoted for life to the hard labours of the lawyer, of the man of fortune and of the man on his way to the ministry, has not had time to surrender himself to the occupied idleness of philosophical studies. When Plato warned that societies would not march correctly while the rulers were not philosophers or the philosophers rulers, he committed an indiscretion which, being such an ancient man, is almost forgivable to him. I, at least, would wish to forgive the disciple of Socrates the indiscretion of demanding that a minister be a philosopher, and likewise that of Señor La Cierva for not being a philosopher. But I would indeed wish to record that reform of customs is an absurdity, and if, as now, it is a matter of reforming the customs of the people, the absurdity is intolerable for anyone with a good logical ear.
In the face of the innumerable problem of life, one individual reacts in one way, another in another: to discover this one does not need to have read the Mahabharata. What makes one individual react in one way, and another in another, is the individual character. The elements of the reaction are, then, the vital medium and the character: the result, which is the visible and palpable, we call custom. The thing is not very complicated; but translating it into mathematics, it shows itself purer and more entertaining: two times four equals eight. To Señor La Cierva the number eight has seemed ugly, which is the result, that is, the custom, and he has wanted to change it. How? By erasing it. The number eight is the one that the feet of the drunkard trace when he comes out of the tavern; and Señor La Cierva has closed the taverns as much as he has been able. Any person who had not studied in Bologna, like Señor La Cierva, would have thought that, to change the product, it is necessary first to change one of the factors. Señor La Cierva, original spirit, proceeds otherwise. From which it is deduced that prohibiting entry into the taverns from twelve o’clock is one and the same thing as prohibiting from the Gaceta the Pythagorean table.
No, Señor La Cierva; no, ill-accorded Celtiberian gentlemen: customs are neither good nor bad. It is the character that is good or bad, it is the vital medium that is good or bad, which arouses the good or bad character: but custom is irresponsible, it is simple, tragic and ineluctably natural, like that Pythagorean table, the just man of Crotona. For that reason, within a high sense of justice, custom is precisely the unlegislatable, because it is not human substance, but natural mechanics, and forbidding a custom is as much worth as forbidding earthquakes in a nation. A law against a custom is not law, but a pragmática. Only when custom and ideal sleep a night together, justice remains pregnant and the law is born.
There is a point in which Señor La Cierva is right: the only direct action possible upon custom is to remove it; but to remove a thing is not to reform it. The only reformable thing is the factor, never the product that obeys physico-mathematical laws, and not laws of justice. The reformable thing is character. The just law is always reform: otherwise it will be revolution or a coup d’état, according to who dictates it. What cannot be reformed is not legislatable. For this reason it seems an absurdity: reform of customs, reform of the unreformable. And Señor La Cierva is the bourgeois gentilhomme of the Puerta del Sol, who instead of making a law, a reform, has made, without knowing it, a revolution or a coup d’état. All in miniature, so that History, with which this Spanish conservative party has so little to do, should not grow weary —the historical party par excellence which, formed around that «revolution from above», has now placed the cherry of the lack of historical sense, undertaking the reform of customs. Let the reader meditate and he will find that both things are like that knife without a blade that had no handle.
Reform of the customs of the people! Blessed be God! But does Señor La Cierva not know that the people is the portion of a society not subject to fashion, of a sacred millenary soul whom all the great politicians have courted so chastely, because they knew that it never entirely loses its virginity? Does he not know that the people is precisely the custom of having the same customs, in opposition to the aristocracies, peripheral, shifting masses that come and go over the ethnic seas according to the capricious wind that blows? I recommend to Señor La Cierva the acquisition of the sixth sense, without which neither philologists nor politicians are possible; I repeat that it is this sense, the respectful historical tentacle with which we must draw near to peoples, to the purebred in each caste, which, like the mother of noble wines at the bottom of the tuns, lying at the bottom of races, gives them savour, dignity and equilibrium. And does Señor La Cierva want to reform this with a royal order? I am on the point, dear reader, of asking your pardon if in what I have written you find a certain light tone of mockery; the ideological errors of some fortunate and ingenious men, without school or political unction, who arrive in the calm of an afternoon at being ministers, deserve no other. But when, looking before oneself at those dark uncertainties that emerge from the depth of centuries and that we call Spanish people or French people or German people, one feels within one’s entrails a religious trembling, as I feel, because from there all the good to come must spring forth, as all the past goodnesses sprang, there is no place to put a redoubt to anger if those men approach them lasciviously or lightly. No, Señor La Cierva, I accuse Your Excellency of being a light politician if with the suffering vices of my people you want to make yourself a parliamentary platform, and I accuse you for having pretended to mock the reliefs of logical discretion that remain in Spain. Be it said without further circumlocution: a government that has not created a single popular school nor dictated a single social law has no right to forbid the people a custom. Next to the horrendous immorality of maintaining, at most one next to the other, two such diverse types of instruction, that of the rich and that of the poor, next to the nefarious one of not concerning itself with the latter, it would be a nun’s scruple if it were not a dishonest mockery to take care of a few more knife-stabbings or a few less drunken binges. Reform of character, Mr. Minister, which is the reformable: instruction and social laws; not reform of customs, not simplistic imitations of what may happen here or there. But let us return to temperance.
It is the case that, in the Congress held not long ago, the German Socialist Party, so rigid and dictatorial, so exacting of its members, put up for discussion the problem of alcoholism. It would have cost it little to order abstinence to the three million German socialists, as it forbids them the duel and with it a certain over-refined honour which is the firewater of men of fortune. It did not do so, however; its resolutions are pleas for education, motions of virtue.
In the prologue to the Royal Order, Señor La Cierva tells us that he wants to «exercise the profitable influence proven in other countries». The same as always: for a century we have been transplanting to Spain all the follies of France, of England, of Germany and none of their wisdoms; because these wisdoms are genuinely French, English or German and, therefore, untransplantable. What is of value in these peoples is character; the customs are different.
Come? Cancellandolo.
No, signor La Cierva; no, signori celtiberi mal riconciliati: i costumi non sono né buoni né cattivi.
I believe I have said unequivocally that the Royal Order of Señor La Cierva envelops in its insignificance a tremendous immorality; in the face of which all the knife-stabs of passion and instinct are venial sins. And if I, who am a citizen as private as I am peaceful, have now come out into the lists with the gear of my own poor weapons, let it be attributed to my considering it a primary duty to protest against that work of disorientation which is being exercised upon the Spanish spirit. And if the Royal Order finds many defenders, the greater will be the sorrow around my soul. For there has begun within Spain, in acts and in writings, a stolid form of seriousness and certain impulses of gravity without wisdom, which he who has placed his loves in the cultural future of this race cannot perceive without unease. Aelian relates in his Historical Miscellany the ancient tale according to which a sick lion, to be cured, had to swallow a monkey. To this lamentable cure they wish to subject the softened Celtiberian lion, fattening it on pedantry. And the more serious, the more precise and the more profound the vision we have of culture, the more the panorama of Spanish idearies must grieve us.
I invite the intellectuals that, overcoming a false good tone which keeps them apart from public problems, they may find themselves obliged to renew the liberal emotion and with it liberalism, a beautiful name that has rolled through Europe and which, by an irony of the muse that governs History, came to emerge from our dark land. Although I believe that present-day liberalism must be socialism, let liberal vibrations come in whatever melody they please: they will take rhythm within the great harmony of our cultural renaissance. The example that Don Miguel de Unamuno offers us with his fiery liberal mysticism well deserves to be followed.
Let us give a philosophical lesson to this blessed Señor La Cierva and repeat to him the ancient Socratic apophthegm, not yet refuted: Virtue is knowledge. If His Excellency wishes to make better Celtiberians, let him make them wiser and foster the intellectuality of that conservative party, to which may be applied what an Italian ambassador wrote of King Philip III: «His majesty likes to live with few thoughts».
Can we expect Señor La Cierva to do something similar? Of myself I can say that I do not hope it. The conservative party seeks a virtue less harsh and surly than the virtue native to the essence. It will not be he, no, who will knead for us with the finest wheat-flour of wisdom the white hosts of culture. This Royal Order shows, very clearly, a loving yearning toward other times simpler than those we should wish to see arriving from the East. And if in anything it seemed inspired, we should suspect that it was in that disputed testament of Cardinal Richelieu, the model of absolutism, where there is a chapter entitled: Jusqu’à quel point on doit permettre que le peuple soit à son aise.
